What is Probate?

In it's simplest terms, probate is the process for transferring title to property from the deceased to someone else.  Probate is a court process, which is initiated by filing a petition for probate and to appoint a personal representative.  The personal representative has job of determining, with the help of a lawyer, the assets and liabilities (creditors) that will be sorted out in the probate process.  In Oregon, the process generally takes 9 months or longer, depending on the complexity of the estate.
